O.C. Gang Member Gets Life In Prison For Killing Blind Man And Stealing His Car - cbs2.com: "Aurelio Fidencio Saldivar, who is a gang member, was convicted on June 17, 2009, of first-degree murder.
Saldivar had no visible reaction as Orange County Superior Court Judge Frank Fasel sentenced him for his role in the killing of Raffi Yessayan in the
city of Orange four years ago.
Saldivar's attorney, Frederick Fascenelli, unsuccessfully sought a new trial, arguing the jury was prejudiced by testimony that his client belonged to a gang run by the Mexican Mafia, and that he did not get competent legal counsel from another attorney during the trial.
Prosecutors said Saldivar and co-defendant Oliveros both shot the victim, who had celebrated his 26th birthday the day before he was slain.
Several other defendants were convicted of lesser roles.
Marco Antonio Charcas-Fernandez, 24, of Santa Ana, pleaded guilty to involuntary manslaughter on July 9, 2009, and was sentenced to five years in prison.
Jose Ramirez Muniz, 40, of Santa Ana, pleaded guilty to being an
accessory after the fact and was sentenced to 45 days in jail and one year of probation.
Yessayan owned a black Nissan sedan with custom rims, but he had his
friends drive him around in it because he was blind."
