Contra Costa County gang member is facing 65 years to life in prison for killing a fellow jewel robber in Richmond over division of the spoils.
Jurors on Friday convicted 43-year-old Major Eberhart of first-degree murder, conspiracy to commit robbery, and charge enhancements for using a gun and committing the crimes for the benefit of a gang.
Eberhart and the homicide victim, Randy Weathers, were among four or five robbers who stole about $20,000 worth of jewelry from a business in Daly City on April 21, 2007. Afterward, the robbers fled to the Crescent Park apartments in south Richmond to split the loot.
Weather and Eberhart belonged to the prison gang, Kumi Nation, prosecutors said. However, gang solidarity could not mediate a dispute over dividing the valuables.
Weathers was caught taking more than his share, deputy district attorney Derek Butts said. Weathers told Eberhart that he would make it up to him, but Eberhart said, "Not in this lifetime!" and shot the 51-year-old San Francisco resident in the head.
A passer-by found Weathers' body the next morning in the bushes near Booker T. Anderson Jr. Park in Richmond.
Four days later, Eberhart contacted the victim's wife in order to lure her into his company. Butts argued that Eberhart wanted to kill her to silence her as a witness, but the woman already was working with police investigating Weathers' death.
